Manchester City face "substantial hurdles" in attempting to overturn their guilty verdict after being found to have breached Premier League financial rules between the 2009-10 and 2017-18 seasons. The ruling determined that the club created "sham contracts" to inflate sponsorship agreements by £830m. However, City insist they are "innocent of the accusations made by the Premier League," maintaining they possess "irrefutable evidence" that the original decision is unsafe and contains "clear material errors, of law, principle and fact."
James Severn, a member of the London Solicitor Litigation Association and partner at Penningtons Manches Cooper, told BBC Sport that the appeal is "not simply an opportunity to invite a new panel." To succeed, City must establish a material error of law, principle, or fact, or demonstrate serious procedural unfairness that materially impacted the outcome. While City will argue that payments were legitimately made by the United Arab Emirates government as a shareholder of the sponsors rather than topped up by the owners, Severn warned that proving an error will be an uphill struggle if that documentary evidence was already evaluated and rejected by the Commission.
The dispute also heavily involves principal sponsor Etihad Airways, which has partnered with City since May 2009. Although 2015 New York court documents recorded Etihad stating the Abu Dhabi government did not fund its sponsorship, City argue that submission lacks full context. Etihad stated it was never granted the opportunity by the Premier League to be represented or provide information, while City are also set to claim that the Commission relied too heavily on and fundamentally misunderstood documents obtained via the Football Leaks files.
Kieran Maguire, a professor of football finance at the University of Liverpool, observed that the Commission concluded "the documents were retrofitted to fit the crime," suggesting City's lawyers could pursue a "mess and noise approach" aimed at discrediting the Commission's process. Although Premier League rules specify an appeal must be heard within 12 weeks, or by Christmas Eve, Severn noted that the vast scale and complexity of the proceedings mean a final outcome may not be known for some time.
